General Terms & Conditions

MEMBERS’ CONSENT

  • 1. These are the terms and conditions which apply to the TOP 1 Kumpare Club (‘TKC’), the loyalty and rewards app for the brand TOP 1 OIL, distributed by Monroe Multinational Group, Inc. (MMGI).
  • 2. By applying for and joining in the TKC, you agree to be bound by these terms and conditions, along with any other specific rules which relate to it. Specific rules may include entry instructions, point accumulation, point expiry, redemption rules, etc.
  • 3. Registering and signing up for the TKC and/or downloading or using the TKC app shall signify your free decision to join and accept the TKC Terms and Conditions as well as the TKC Privacy Policy.

PARTICIPATION IN THE TKC

  • 1. The TKC is only open to the following types of entities, collectively referred to as eligible TKC Participants:
    • a. All participating TOP 1 OIL Dealers (Owners and Employees) in the Philippines whose shop profiles have been verified by MMGI.
    • b. TKC participants who are corporations, partnerships, enterprises and sole proprietors must be lawfully incorporated in accordance with Philippine laws.
    • c. TKC participants who are individuals must not be less than 18 years old at the time of registration and sign-up to the TKC.
    • d. This app is specifically designed and intended for internal use of official TOP 1 Dealers and Distributors only. It is not intended for public use or for end users.
  • 2. To participate in the TKC and earn/ redeem points in it, eligible participants must:
    • a. Successfully register themselves in the TKC sign up page found in the TKC mobile app, fully completing all required profile details. The mobile number linked to the participants’ profile should be an active Philippine mobile number.
    • b. Fulfil the participants’ eligibility criteria mentioned in above clause.
  • 3. The TKC is only open to the following types of entities, collectively referred to as eligible TKC Participants:
    • a. Participate in the TKC and be bound by its Terms and Conditions;
    • b. Allow MMGI to process and/or share all personal data of TKC Participants for matters related to or arising from the course of business.
    • c. Allow MMGI to collect, use, disclose and share amongst themselves and their respective service providers, the TKC Participants’ Personal Data, for purposes of operating the app;
    • d. Authorize MMGI to process Personal Data in accordance with MMGI’s Privacy Policy.
  • 4. In case participants lose their mobile phone or need to change their registered mobile number for any reason, they need to contact MMGI head office and request for change in mobile number. A verification process will be conducted again before approving such request.

POINTS REDEMPTION

  • (A) GCASH
  • 1. Points earned in the TOP 1 Kumpare App may be converted to Gcash. The conversion of points to Gcash however will be done through a manual disbursement process, which may take up to 5-7 working days. Manual verification is done to prevent fraud and to ensure correctness of Gcash recipient numbers and Gcash amounts to be sent.
  • 2. The customer/ user of the TOP 1 Kumpare App may choose to send Gcash to any mobile number other than the mobile number registered with the App. In this case, it is the customer/ user’s responsibility to input the correct and complete registered Gcash name of the recipient as well as correct Gcash mobile number. Should the customer/user input an incorrect Gcash number and Gcash has been erroneously sent, there shall be no refund.
  • 3. The amount/s to be sent via Gcash can only be in the following pre-set denominations: P1,000, P5,000 and P10,000. If the points balance of the user/customer is less than P1,000 then the user/customer is not eligible for Gcash redemption.
  • 4. When the user/customer clicks on Gcash redemption button in the TOP 1 Kumpare app, there will be a prompt that reminds the user of the above Terms and Conditions. Clicking “agree” on it signifies that the customer/user has read all the above and agrees with the same.
  • (B) MOBILE LOAD
  • 1. Points earned in the TOP 1 Kumpare App may be converted to mobile load. The conversion of points to mobile load will be done through a fully automated real-time system.
  • 2. The customer/user of the TOP 1 Kumpare App may choose to send mobile load to any mobile number other than the mobile number registered with the App. In this case, it is the customer/user’s responsibility to select the correct Telco provider and input the correct mobile number of intended recipient. If mobile load is erroneously sent due to wrong input by the customer/user, then there shall be no refund.
  • 3. The amount of load to be sent per transaction shall only be in Php 300 denominations.
  • 4. In order to prevent fraudulent transactions, there shall be a programmed lull time/ system gap time between load request transactions. After one request is made, there will be a lull time/ system gap time of 30 minutes before another load request can be made.

POINTS ACCUMULATION

  • 1. Customers/users of the TKC can earn and accumulate points by scanning the QR Codes of participating TOP 1 Products.
  • 2. Points earned by a specific user are for that user only and may not be merged with points earned by another account.
  • 3. All points are non-transferrable.
  • 4. All points have an expiry as explained in the “EXPIRY OF POINTS” section below.

EXPIRY OF POINTS

  • 1. All points earned in the TOP 1 Kumpare App have an expiry according to the Point Expiration Chart provided below.
  • 2. Expired points will automatically be deducted from the customer’s points balance on the date of expiration. This will be reflected in the customer/user’s transaction history.
  • 3. All expired points are no longer valid and can no longer be used for redemption of any reward.

ERRORS OR DISPUTES

  • 1. When it comes to points redemption, MMGI shall not be held liable for load or points that have been erroneously sent if the error is due to customer negligence, customer’s wrong input of digits, or any similar error caused by the customer.
  • 2. In cases of doubt or dispute, MMGI’s decision on all matters shall be deemed final and binding; no correspondence or appeals shall be entertained. This includes decision on membership, accumulation of points, conversion of points, redemption of benefits, etc.

TERMINATION & LIABILITY

  • 1. MMGI reserves the right to cancel, terminate or suspend the TKC or any of its participants with or without any prior notice. In the event that MMGI cancels, terminates or suspends the TKC, participants are not entitled to any claim or compensation against MMGI for any and all losses or damage incurred by any party as a direct or indirect result of the act of cancelation, termination or suspension.
  • 2. All TKC Participants shall be personally responsible for all taxes, rates, government fees or any other charges that may be levied against them under applicable laws, if any, in relation to the TKC.
  • 3. MMGI reserves the right at its absolute discretion to amend, delete or add to any of the TKC Terms and Conditions from time to time without prior notice.

AMENDMENTS

  • 1. Once there is any amendment to the TKC and its Mechanics or Terms and Conditions, the amended version shall prevail over any provision or representation contained in any other promotional or advertising material.
